Under North Carolina statutes, a legal separation may be granted only for cause. While the state does recognize a no-fault divorce, the courts will only approve separation in the event there is fault by one spouse or the other. Should a legal separation be granted, there are other issues which will be determined including child custody and support, property division, and spousal support.
